Child Falls Nine Stories out of an Elevator

Investigation still in place after a child fell out of an elevator, causing his death. Code Enforcement inspectors were on scene at the Pinnacle Apartment to wrap up the investigation on this tragic, fatal elevator accident.

On a Monday night, Xayvion Carlton died when he fell nine stories down an elevator shaft. The outer door gave way and the boy fell because the door was missing a small plate that keeps the door on track. Xayvion was just three years old.

That Wednesday, the local News (Action News 5) investigated who was at fault for the elevator’s malfunction. Local ordinances in Memphis state that it is the building owner’s responsibility to maintain the elevator in a safe and reasonable manner. The owner usually hires an elevator contractor to do this.

The company with the maintenance contractor of the elevator, Schindler Elevator, said in a statement through their NY public relations firm that “Schindler Elevator extends it’s deepest sympathy to the family and the friends of the young boy who died following a tragic accident at the Pinnacle Apartments in Memphis Monday night. The matter is under investigation and it would be inappropriate to speculate about the cause. "

Action News 5 went to the management office of the building where the accident occurred for a comment but they were asked to leave the property. No one associated with the apartment complex would give any type comment.

An Elevator Inspector, Charlie Haines said that he and another individual inspect all of the 3,000 elevators in Shelby County once a year. He also said that although the rest of the state is required to do inspections two times a year, ordinances in Memphis only require on inspection per year.
