Accident Work Injuries

Work Incident in Ventura County

A man doing his everyday job sadly passed away. The man was working with a tree service and died after an accident occurred at work.

The accident happened a little bit before 3:30 in the afternoon. The work related incident happened in the gated community of Bell Canyon.

According to the CHP reports, the worker was identified by the Los Angeles County coroner’s office as thirty-six year old Roberto Cortez. Apparently he recieved his injuries after he jumped from the back of a tree service truck. He was trying to escape an uncontrolled vehicle. Cortez was taken to a local hospital by the paramedics however he was pronounced dead at 5:40 that evening.

The California Highway Patrol (CHP) said that the truck was parked on a steep roadway. The workers were busy loading branches onto the truck. There was a worker standing in the back of the truck, who was working on organizing the branches. For unknown reasons the truck slipped into drive and began to travel down a roadway with no driver. Talk about a terrifying experience.

Worker Tries to Escape Accident

As the vehicle was gaining speed the worker tried to leap from the back of the truck and onto the roadway. After he bailed the truck kept on going westward. The runaway truck ended up hitting two vehicles and later came to a stop when it hit a fire hydrant.

The reports showed that two pedestrians were standing next to a vehicle that the runaway vehicle hit. They received minor injuries.

The police were unable to identify the name of the tree service company at this time.

However, the accident is still under investigation by the California Division of Occupational Safety and Health as well as the CHP.

Crash Shuts Down Freeway

Another day another crash. When you’re on the road you take that chance daily, whether you want to or not.

Recently, there was an accident involving a semi truck. The crash caused all of the southbound lanes on the 215 Freeway in Riverside to be shut down.

The crash happened just after noon at the Van Buren Boulevard exit. According to the reports, the semi truck was towing a trailer and was travelling northbound.

For reasons unknown at this time, a car veered into the center median. The car hit the guardrail then overturned. The trailer then went into the southbound lanes.

As cars were passing through, the trailer went through and struck four cars. One of the drivers of one of the hit cars had minor injuries.

The emergency officials said that the driver of the big rig was luckily extricated from the wreckage. There was a female passenger in the truck with him. The driver suffered from major injuries and was taken to a local hospital. The woman passenger suffered from moderate injuries.

The 215 southbound Freeway was closed between Van Buren Boulevard and Harley Knox Boulevard. Luckily the lanes were mostly reopened by that evening.

Tour Bus Crashes with Semi

Tour bus tours always kind of scare me. That’s a whole lot of people in a tiny space, and if something happens you’re stuck.

Local news reported that there was a horrific crash on Sunday in California. The crash sadly ended with thirteen people dead and dozens more injured. This was due to a tour bus crashing with a semi truck.

According to CHP, the accident happened early morning around 5:17 a.m. in the westbound lanes of the 10 Freeway at Indian Canyon. The big rig driver was hauling food products at the time of the accident. The driver of the truck only had moderate injuries. According to the police, the big rig driver said that he felt a “thump” in the back but that’s all that he really knew.

CHP Border Division Chief Jim Abele’s Statement:

The speed of the bus was so significant that when it hit the back of the big-rig trailer, the trailer itself entered about 15 feet into the bus. So you can see there was a substantial impact.

All of the 44 people who were on the bus were believed to be adults. CHP Chief couldn’t say if the expected deaths toll would rise.

The tour bus was a 996 USA Holiday bus. The company is a Los Angeles based company. They usually ferry people from LA to the nearby casinos.

Abele did say that the bus had been inspected the last three years and never had any mechanical deficiencies reported. The report shows that the bus also had no prior crashes.

The crash caused the Freeway to be shut down for a little while. During the crash, most of the passengers were asleep on the bus.

Work Accident

Suggested Steps in order to control workplace hazards and eliminate or reduce the risk, you should take the following steps:
    1. identify the hazard by carrying out a workplace risk assessment;
    1. determine how employees might be at risk;
    1. evaluate the risks;
  1. record and review hazards at least annually, or earlier if something changes.

Worker’s Comp In California

Calculate the maximum benefit he is able to receive as a workers’ compensation payment. Use his weekly wage to determine his workers’ compensation temporary disability benefit. Formulate two-thirds of his weekly salary to obtain the result. For instance, for the employee who makes $1,000 per week, use the formula $1,000 multiplied by 2/3 to equal $666.66 per week.

So if you have an incident at work try to work with your employer to figure out the best way to get your claim started. Be patient, most of the time your employer’s are more than willing to help get the ball rolling on the claim. However, sometimes they do need a little push or some are downright hateful about it. But just stay calm and try to follow the order of command. If need be please contact our law office and we would be more than happy to help you get this situation settled.  We will be very assertive to every case.
